Turchia: sfida all’Europa sui diritti

Vero o finto che sia stato il tentativo di colpo di Stato dei militari, il regime autoritario del presidente turco Recep Tayyip Erdogan lo ha accolto come “un dono di Dio” e un’occasione per sbarazzarsi una volta per tutte di ogni opposizione, soprattutto quella civile e democratica, che in questi giorni viene aggredita, imprigionata, umiliata.

Con il pretesto, finora indimostrato, che i suoi oppositori siano complici del tentativo di colpo di stato, Erdogan ha deciso di portare a compimento la sua politica di annientamento di ogni dissenso, calpestando leggi interne e convenzioni internazionali sottoscritte dalla Repubblica turca, e trasformando la Turchia in un potente centro di destabilizzazione regionale.

A tutti i popoli, e specialmente a quello curdo, che stanno soffrendo il potere sopraffattorio e oppressivo di Erdogan va la nostra solidarietà attiva di persone che lottano affinché i diritti umani e i diritti dei popoli prevalgano sugli interessi politici ed economici dei poteri dominanti.

Nel recente convegno internazionale svoltosi a Roma il 4 e 5 luglio scorso, organizzato dalla Fondazione Lelio Basso, abbiamo denunciato la vergogna di cui si è macchiata l’Unione Europea quando ha accolto le condizioni del regime turco, finanziandolo e stipulando con Erdogan un “patto di morte” ai danni di persone disperate che fuggono dalla violenza della guerra e della fame, e che un’Europa egoista non riesce a distribuire tra i suoi paesi membri.

I fatti atroci di questi giorni confermano l’intollerabilità dell’autocrazia di Erdogan e l’assoluta inadeguatezza e ipocrisia delle prese di posizioni di facciata dei governanti europei quando si limitano a sollecitare cautela al governo turco, non mancando nel contempo di ricordarne la democratica elezione, così riducendo la democrazia a mera investitura, in violazione del patrimonio di diritti e di libertà proprio della civiltà europea, secondo cui non è democratica una società in cui non siano garantiti i diritti fondamentali.

Ogni colpo di stato militare, quale che sia l’intenzione degli autori, è inaccettabile. Ugualmente intollerabile tuttavia è una dittatura, per quanto fondata sul consenso della maggioranza, che calpesta i diritti elementari delle persone e delle minoranze, e ripudia lo stato di diritto. Con la destituzione di migliaia di magistrati e l’arresto di centinaia di giudici e procuratori – il più grave attacco all’indipendenza della magistratura realizzato in una società europea contemporanea – si distruggono non soltanto pilastri essenziali dello Stato di diritto, rappresentati dalla separazione dei poteri e dalla giurisdizione libera da condizionamenti del potere esecutivo, ma si mette a repentaglio la stessa possibilità che i diritti possano essere garantiti contro l’oppressione e l’abuso del potere.

Sulla società turca sta calando una soffocante cappa di oscurantismo e di oppressione: liste di proscrizione, epurazioni di massa, divieto del diritto di espatrio, compressione del pluralismo e sospensione di decine di migliaia di docenti e insegnanti, persecuzione di giornalisti, di avvocati e di rettori di università, arresti di massa, annichilimento della libertà di stampa, fabbricazione del sospetto, paura, torture.

La sfida per la comunità internazionale è reale. E per l’Europa, è arrivato il momento di decidere che cosa fare, per declinare veramente e con coerenza i tanto conclamati diritti. Il regime turco non può far parte dell’Europa, della sua cultura giuridica e pluralistica, non soltanto per la prospettata futura reintroduzione della pena di morte, ma per la già avvenuta continua violazione delle libertà fondamentali e dei diritti umani e civili.

Chiediamo al Consiglio d’Europa e l’Unione Europea di non limitarsi più a manifestare critiche formali o generiche preoccupazioni. L’Unione europea deve, con urgenza,

cancellare il vergognoso accordo stipulato con la Turchia in violazione diritti elementari delle popolazioni migranti, e delle stesse convenzioni che l’Europa si è data;
interrompere ogni commercio finalizzato, anche indirettamente, al potenziamento bellico o tecnologico di sicurezza della Turchia, a cominciare dalla esportazione di armi;
è infine indispensabile isolare il regime turco e, perciò, adottare con urgenza tutte le sanzioni e iniziative legittime, cominciando con il sospendere la Turchia da ogni partecipazione a istituzioni e organismi europei.
Soltanto se saranno presi sul serio le Convenzioni, i Trattati e le Carte dei diritti fondamentali contro ogni tentativo, manifesto od occulto, di mettere in discussione il patrimonio di diritti e libertà su cui sono fondati il Consiglio d’Europa e l’Unione europea, le Istituzioni del nostro continente saranno all’altezza della necessità imposta dalla tragedia in atto e riusciranno a riconquistare la fiducia e il consenso di persone e di popoli che ancora cercano nell’Europa il punto di riferimento per rivendicare e realizzare aree di libertà, di diritti e di giustizia.

An appeal to

Turkey: the challenge to Europe on human rights

Whether the attempted military coup was real or staged, the authoritarian regime of the Turkish President Recep Tayyip Erdogan has welcomed it as “a gift from God” and, indeed, an opportunity for getting rid of all his opponents, including all forms of civic and democratic opposition, which these days are being systematically attacked, imprisoned, humiliated.

Under the pretext, so far unproven, that his opponents are accomplices in the attempted coup, Erdogan has resolved to put an end to any dissent in his country, trampling on both Turkish laws and those International Conventions to which the Republic of Turkey is a Party. By so doing, he has transformed Turkey into a powerful centre of regional destabilization.

Our active solidarity, as institutions and persons who struggle to ensure that human rights and the rights of peoples prevail over the political and economic interests of hegemonic powers, goes first and foremost to all the peoples, especially the Kurds, who have been suffering President Erdogan’s bullying and oppressive power.

In the recent international conference organized by the Fondazione Lelio e Lisli Basso to celebrate the 40th anniversary of the Universal Declaration of Peoples’ Rights, held in Rome on 4-5th July, we strongly denounced the shameful decision of the European Union to embark into a death pact with the Turkish regime against desperate people who migrate to escape the violence of war and hunger, and whom selfish Europe fails to allocate among its members.

The tragic events of these days confirm the intolerability of Erdogan’s autocracy and the absolute inadequacy and hypocrisy of the response of European leaders, when they merely urge the Turkish government “to act with caution”, while repeatedly recalling that it was democratically elected. By so doing, they reduce democracy to a mere investiture, in violation of the heritage of rights and freedoms that are part and parcel of European civilization. Based on this legacy, a society that does not guarantee fundamental rights is not democratic.

Every military coup, whatever the intention of its perpetrators, is unacceptable. But equally intolerable is a dictatorship, even when grounded on the consent of the majority, whose aim is to trample on the basic rights of individuals and minorities and to reject the rule of law. With the dismissal of thousands of magistrates and the arrest of hundreds of judges and prosecutors – the worst attack ever on the independence of the judiciary in a contemporary European society – not only the essential pillars of the rule of law, entrenched in the separation of powers and in a judiciary free from the conditioning of the executive, are being destroyed. Indeed, the very possibility of securing rights against any oppression and abuse of power is put at stake.

A suffocating pall of obscurantism and oppression is being cast on Turkish society: proscription lists, mass purges, the ban on travel abroad, the crush on pluralism and the suspension of tens of thousands of teachers, the prosecution of journalists, lawyers and university rectors. Mass arrests, the extinction of any freedom of the press. Finally, the manufacturing of suspicion and fear, the practice of torture.

The challenge to the international community is real. And for Europe, time has come to make up its mind about a real and coherent agenda on human rights, so frequently proclaimed. The Turkish regime cannot be part of Europe, of its legal and pluralistic culture, not only because of Erdogan’s proposed reintroduction of the death penalty, but for the continued and ongoing violations of fundamental freedoms and human and civil rights.

We ask the Council of Europe and the European Union not to just manifest formal criticisms or generic concerns. The European Union must, with a sense of urgency:

cancel the shameful agreement stipulated with Turkey in violation of migrant peoples’ fundamental rights, and of the very Conventions that Europe has agreed to incorporate into its jurisprudence;
suspend any trade aimed, albeit indirectly, to enhancing Turkey’s military and technological security system, starting with the export of weapon systems and light weapons;
It is essential to isolate the Turkish regime and urgently adopt all legitimate sanctions and initiatives, starting with the suspension of Turkey from any participation in European institutions and bodies.
Only if European institutions do take the human rights conventions, treaties and charters seriously, against any manifest or hidden attempt to question the legacy of rights and freedoms forming the basis of the Council of Europe and the European Union, will they manage to re- conquer the trust and consent of those peoples and individuals who still seek in Europe a reference to demand and create spaces of freedom, human rights and justice.
